1. About this policy

In Pit Solutions Pty Ltd (ABN 14 150 019 917) (we, us, our) respects your privacy. This policy explains how we collect, hold, use and disclose personal information, and how you can access, correct or complain about the way we handle it.

We handle personal information in accordance with the Privacy Act 1988 (Cth) and the 13 Australian Privacy Principles (APPs) set out in that Act.

This policy applies to our website, our email and SMS marketing communications, and to personal information we collect in the course of our business. It does not apply to third-party websites we link to, which have their own privacy policies.

2. What personal information we collect

Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable. The kinds of personal information we collect and hold include:

Contact details — your name, email address, phone number, and postal or business address.

Business details — your job title, employer or company name, and industry.

Enquiry and correspondence records — the content of your enquiries, quote requests, emails and other communications with us, and our responses.

Marketing information — your subscription status and communication preferences, the date and source of your consent, and engagement data such as whether you opened an email or clicked a link.

Technical and website information — your IP address, browser and device type, operating system, referring pages, and the pages you view on our website.

We do not generally collect sensitive information (such as health information, racial or ethnic origin, political opinions, religious beliefs, or criminal record). If we ever need to, we will only collect it with your consent and where it is reasonably necessary for our functions or activities, or where the law otherwise permits.

3. How we collect personal information

Wherever it is reasonable and practicable to do so, we collect personal information directly from you. We collect it:

Directly from you — when you subscribe to our mailing list, complete a form on our website, email or call us, meet us at a trade event or site visit, or give us your business card.

Automatically — through cookies and similar technologies when you use our website (see section 5).

From third parties — such as publicly available business sources, referrals, or our service providers. Where we collect your personal information from someone other than you, we will take reasonable steps to notify you, or make sure you are aware, that we have done so.

4. Why we collect, hold, use and disclose personal information

We collect, hold, use and disclose personal information for the following purposes:

To respond to your enquiries and provide quotes, information, products and services.

To send you marketing and promotional communications you have asked to receive, including newsletters, product updates and event invitations.

To manage and improve our relationship with you, and to keep accurate business records.

To operate, maintain, secure and improve our website and communications.

To comply with our legal and regulatory obligations, and to establish, exercise or defend legal claims.

We will only use or disclose your personal information for another purpose where you would reasonably expect it and that purpose is related to the purpose we collected it for, where you have consented, or where we are required or authorised by law to do so.

5. Cookies, analytics and our website

Our website uses cookies and similar technologies to make the site work, remember your preferences, and understand how the site is used. Some of these are set by third-party analytics and advertising providers.

The third-party tools we currently use are: Google Analytics, Mailchimp.

You can set your browser to refuse or delete cookies. If you do, some parts of our website may not work as intended.

6. Direct marketing and how to opt out

We only send you marketing communications where you have given us your consent, or where you have an existing business relationship with us and would reasonably expect to receive them. Our electronic marketing complies with the Spam Act 2003 (Cth).

Every marketing email or SMS we send will clearly identify us and include a working unsubscribe facility. You can opt out at any time by:

clicking the unsubscribe link in any marketing message we send you; or

We will action your request within five working days. You may also ask us at any time not to use or disclose your personal information for direct marketing purposes, and to tell you where we obtained your information from. We will respond within a reasonable period and at no charge.

7. Who we disclose personal information to

We may disclose your personal information to:

Service providers who help us run our business — including our email marketing platform, customer relationship management system, website host, IT and cloud storage providers, and professional advisers. We require these providers to handle your information consistently with this policy and the Privacy Act.

Related entities and, where relevant, our contractors and business partners, for the purposes described in section 4.

Government agencies, regulators, courts or law enforcement, where we are required or authorised by law to do so.

We do not sell your personal information.

8. Overseas disclosure

Some of the service providers we use store or process personal information outside Australia. This means your personal information may be disclosed to, or accessible from, overseas recipients.

The countries in which those recipients are likely to be located are: New Zealand.

Before disclosing personal information overseas, we take reasonable steps to ensure the recipient handles it in a way that is consistent with the Australian Privacy Principles.

9. How we hold and protect your information

We hold personal information in electronic form in our business systems and in the systems of our service providers, and sometimes in hard copy. We take reasonable steps to protect it from misuse, interference and loss, and from unauthorised access, modification or disclosure. Those steps include access controls and passwords, secure storage, confidentiality obligations for our people, and regular review of our systems.

No method of transmitting or storing information is completely secure. While we take our obligations seriously, we cannot guarantee the security of information you transmit to us over the internet.

10. Data breaches

If we suffer a data breach that is likely to result in serious harm to any individual whose personal information is involved, we will assess it promptly and, where the Notifiable Data Breaches scheme applies, notify the affected individuals and the Office of the Australian Information Commissioner (OAIC) as required.

11. How long we keep personal information

We keep personal information only for as long as we need it for the purposes described in this policy, or for as long as we are required to keep it by law (for example, financial and tax records). When we no longer need it and we are not required to retain it, we take reasonable steps to destroy it or to de-identify it.

12. Dealing with us anonymously

You have the option of dealing with us anonymously or under a pseudonym, unless it is impracticable for us to do so or the law requires otherwise. Please note that if you do not give us your contact details, we may not be able to respond to your enquiry or send you the information you have asked for.

13. Accessing and correcting your information

You can ask us for access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. To make a request, contact our Privacy Officer using the details in section 15.

We will respond to your request within 30 days. We do not charge you for making a request; we may charge a reasonable fee to cover the cost of giving you access. In limited circumstances the Privacy Act allows us to refuse a request — if we do, we will tell you why in writing and explain how you can complain.

14. Complaints

If you think we have breached the Australian Privacy Principles or mishandled your personal information, please contact our Privacy Officer using the details below. We will acknowledge your complaint within (5) business days and aim to resolve it within 30 days. If we need more time, we will let you know.
